What are my options if the concrete encased rebar was bent over and poured in by the concrete contractor. Breaking up concrete'

You may not have a choice, it depends on what the AHJ says. 250.50 requires you to use it unless your area has ammended it or you can convince the inspector that the building is an existing structure.

I know, that last part wasn't funny.

I explained a similar situation to the building owner. The contractor responsible core drilled and gave us an access point. This is not a new requirement. I don't care that the rebar makes it harder to pour and finish the floor. They all know by now. Time to make them pay up.

Make another concrete encased electrode. Dig down next to the foundation, and put in either 20 feet of rebar or 20 feet of #4 copper. Pour concrete so it has at least 2 inches around the rebar or conductor. 250.53(A)(3)(2) allows the use of one of the C.E.E.'s when more than one is present.

If the spec said the rebar was to be exposed for the connection and the concrete contractor bent it back (after inspection?), then they didn't meet the spec. It shouldn't be your problem, it should be theirs.
