Yes 240.4(G) for #12 in regards to 310.16 for ampacity.

Yes you can use 12 AWG for this with the 35 amp breaker.

12 AWG is rated 25 amps.

If #12 is minimum #4 will be many times better:grin:

Tell them if 3 ton unit is what they calculate is needed they should put in 5 ton just in case, should not cost any different.
