Control Belden Cable = Flexible Cable??

I have an inspector telling me that the control wiring specified as Belden cable between the transfer switch and the generator is considered as flexible cable and is not permitted for this use in NEC 400.8.

I don't believe this is considered flexible cord. Is there some code that I can use to dispute this?
 
I looked at the table - I didn't see Belden cable listed.

This is what I've got worded so far...

"Belden #8623 wire is specified as control wiring between the generator and the transfer switches. It is listed as audio, control, and instrumentation cable. This does not fall under Section 400.8 of the NEC because it is not actual wiring for the ATS. The actual wiring for the ATS is shown on sheet E-12. Belden cable is not listed in Table 400.4 as a type of flexible cable."

Does that sound sufficient?
 
Surely you know that Belden is a brand, and they make lots and lots of different types of cables. What are all the markings on your cable?
 
Yes I know Belden is a brand.

I pulled up the cutsheet of the cable on the Belden website.

It is a 15 wire, 16 awg, 'audio, control, and instrumentation cable'
 
Don't all premises wires have to be one of the listed choices? In this case, perhaps CL2 or CL1 would be appropriate. Unlisted cables may not be flameproof and would require a raceway.

Is it run in any plenum rated cielings and is it plenum rated if it is??

What is the type of jacket? What lettering is on it?
