CSA Seal

I am in Massachusetts. I am inspecting fixtures without a UL Seal but they have a CSA Seal do I have to accept them?

90-4. Revise the first two paragraphs to read as follows:

90-4. Enforcement. This Code shall be used by the authority enforcing the Code and exercising legal jurisdiction over electrical installations. The authority having jurisdiction of enforcement of the Code shall accept listed and labeled equipment or materials where used or installed in accordance with instructions included with the listing or labeling. The authority shall have the responsibility for deciding upon the approval of unlisted or unlabeled equipment and materials, and for granting the special permission contemplated in a number of the rules.

110.2 of the NEC states that "The conductors and equipment required or permitted by this code shall be acceptable only if approved." Article 100 defines approved as "acceptable to the authority having jurisdiction". Thus, if you are the AHJ, YOU decide on the approval of equipment. You may base your approval on the fact that a recognized testing agency has tested and listed a piece of equipment, but you are not required to accept a piece of equipment just because it has a label from a recognized testing agency. You would probably need a good reason not to accept equipment that is listed and installed according to the listing, but the final decision rests with the AHJ.
 
Doesn't CSA stand for "Confederate States of America"?

The AHJ has makes the decision on whether a piece of equipment is acceptable. I can't imagine an AHJ not accepting a piece of equipment with the csa listing. But if you have a real concern, the correct thing to do would be to fail the job, and let the EC appeal to the board.

And as Iwire points out frequently, the town inspector is probably not the AHJ. The board of examiners would be considered the AHJ, technically, I believe.

The NEC does not require fixtures to be listed or labeled by a third party. I thought NC was the only state that required UL listing.
