I was reading past posts about dedicated space above and below a panel. Some believed this rule didn't necessarily apply to flush mount panels, their reasoning being someone is more likely to be bringing new conduits into a surface mount install.

I would say I disagree and think it does(and should) apply also to flush mount installs. What do you all think? I have a current situation where I am telling the contractor they need to move some ducting out of that space but I want to make sure I am bing reasonable.
 
Point of demarcation seems to be a finished ceiling, anything below would be restricted by the code.

110.26(E)(1)(a)
Dedicated Electrical Space. The space equal to the width and depth of the equipment and extending from the floor to a height of 1.8 m (6 ft) above the equipment or to the structural ceiling, whichever is lower, shall be dedicated to the electrical installation. No piping, ducts, leak protection apparatus, or other equipment foreign to the electrical installation shall be located in this zone.
 
If you need the space for the electrical installation, the duct-work is in the way, period.

Tell them that you will drill holes through the duct for your wiring if they don't move it.
 
I don't see how you can ever install a flush mounted panel and have compliance with this rule as there is no allowance for the top plate of the wall in the rule. :D
