derating

after asking several local inspectors I still havent recieved a conclusive answer. The problem : I have a 2 inch conduit run from the service entrance panel to the attic,where it is ended with a bushing. I have several romex conductors run through this to the panel .Do I have to derate these ?

Say its more than a 10' long piece of conduit (and thats where the violation lays). Is the solution to cut the conduit off at ten feet and run the NM cable by itself from the service panel to the new start of the conduit?

does this make any sense at all?
