Manufactured rooftop exhaust fan for small kitchen hood has a prewired disconnect switch that has the hot and neutral on the switch. I'm suppose to supply 120v to this switch. The switch is a double pole double throw. Is this legal? Why is the neutral on the switch? Is there something that allows this?

It is legal and quite common on HVAC equipment. Typically fan power boxes have a small double pole toggle switch with the exact same setup. Can't say that I know why.

I don't know if justify is the right word. I would say that 430.105 definitely permits this installation but doesn't shed any light as to why the manufacturer has it set up this way.

I guess thats what I was looking for. An article that allowed this setup.
