existing 3 pole breaker to feed single phase 240v circuit.

I'm installing a single phase 240v circuit for an ac; the existing distribution center has some spare 3 pole breakers.I know these breakers are obsolete and expensive. can you use a 3 pole breaker and only use 2 legs and be code compliant.
