For what it's worth the NEC removed the 42 circuit limit for 2008. Now we are only limited by the panel listings.

Soon enough there will be 80 circuit panels.

I would say Roger's answer is on the money.

Article 90 was never intended to be anymore then an introduction. I doubt your 90.9 red tag would stand up to any real scrutiny.

There's nothing in 90 that can be enforced unless you roll over and let some out-to-lunch inspector do it.

I don't think your skit says anything that has a bearing on the introduction having any weight as far as being code

Article 90 can be enforced, it is a part of the NEC. However, the section in debate...

90.8(A) Future Expansion and Convenience. Plans and
specifications that provide ample space in raceways, spare
raceways, and additional spaces allow for future increases
in electric power and communication circuits. Distribution
centers located in readily accessible locations provide convenience
and safety of operation.

...does not contain a rule. It is simply a statement. There is no "shall" or "shall not" contained in it, it's simply defining what "Future Expansion and Convenience" is.

For example, consider this statement:

Most varieties of grass are green when they are alive.

Do you take from that a commandment to keep grass green, or alive? Or do you read that under certain conditions, a certain result is evident?

90.5 tells us how to read the NEC, and what certain key phrases are. There are no mandatory or permissive rules in 90.8.
 
When you install a 6/12, 8/16, 12/20, or 30/40 panel, etc, and fill the panel with regular breakers, there is a still room in the panel for some future expansion, using tandem breakers.
