Feeder tap with equal size conductor

Can I tap off a feeder with the same size conductor as the main feeder from the same Circuit Breaker?

That would not be a tap as defined in the NEC. It is simply a spice and is permitted. Note, this assumes that the main feeder conductor has an ampacity at least equal to the rating of the feeder OCPD.
