Florida and the 2008 NEC

It didn't happen on July 1. The last I heard was that it might be in September 2009, but I can't confirm any date.

In Florida, it will happen when it happens. Don't even try to guess. You will fall short every time. One day Poof! it will be done.

2 years ago there was talk about skipping the 2008 all together and adopting the 2011 on Jan 1, 2011. If you belive that will happen I have 6 acres of........

Dear all interested parties:

The purpose of this email is to provide you with an update regarding the current update to the 2007 Florida Building Code. At the June 9, 2009 Commission meeting, the Commission held a rule adoption hearing regarding Rule 9B-3.047 for the purpose of reviewing and taking action on the proposed glitch code changes to the 2007 FBC including the update to 2008 National Electrical Code (NEC). As the result of the hearing, staff published a "Notice of Change" detailing the changes as approved by the Commission. The changes are posted at the link below and titled "Notice of Change as a result of the June 9, 2009 hearing".

As per Chapter 120, Florida Statutes procedures, the Notice of Change was noticed/published for 21 days; however because of a technical oversight in the notice, we issued another "Notice of Change" which also must be published for 21 days. After the notice is complete, the Rule will be filed with the Department of State. The projected effective date for the proposed changes is now late September 2009.

Also, please note that according to 553.73(7), Florida Statues, which states in part "…Following the approval of any amendments to the Florida Building Commission by the Commission and publication of the amendments on the Commission’s website, authorities having jurisdiction to enforce the Florida Building Code may enforce the amendments." This means that enforcement agencies such as local building departments, as of June 9, 2009, may enforce the provisions of the "Notice of Change" noted above including the 2008 NEC or wait until the official adoption of the rule which is projected to go into effect late September 2009.

I talked to Bruce Ketcham at the State of Florida, Department of Community Affairs, Building Codes and Standards. Bruce's opinion is that the 2008 NEC will be officially accepted by the end of October, 2009. However, local AHJs may elect to utilize the 2008 Code any time prior to the official acceptance.

The DCA has issued an official effective date of October 1st, 2009 for the 2008 NEC. All permits issued between June 9th and September 30th are permitted to comply with the 2008 NEC, while all permits issued on October 1st and after MUST comply with the 2008 NEC. Local jurisdictions had / have the option of adopting the NEC locally anytime after June 9th. Please consult your local AHJ to confirm the effective date there.

The purpose of this email is to inform you that the effective date for Rule 9B-3.047 which adopts by reference the glitch code changes to the 2007 Florida Building Code as approved by the Florida Building Commission June 9, 2009 including the 2008 National Electrical Code (NEC) is October 1, 2009. The glitch code changes are posted at the link below and titled “2nd 2009 Supplement – effective October 1, 2009”.

Also be aware that October 1st will be the official date the ECLB will begin testing on the 2008 NEC. Prepare accordingly.
