Fraction hp motors verses more than 1 hp

430.32(A)(1) indicates that overload protection be provieded by one of the means in (A)(1) through (A)(4) be applied for motors with more than a horse power.

I have the following questions.

1-when is seperate overload protection required for both 430.32(A) and 430.32(B).
2-where must be the location of the overloads, when seperate overload protection is required.

I had a situation where an exhaust fan on the roof required seperate overload protection by the manufactures specs. The exhaust fan operated through a relay on the first floor of a 4 story building. The contractor wants to replace the contactor with a motor start with overloads. I recommended that he install the overload protection at the exhaust fan.
