Is it a valid argument to require GFCI protection for a hardwired A/C condensing unit with generic wiring method to outdoor safety switch (lever or pullout) and a hardwired condenser (utilization equipment) with a field installed wiring method used between the condenser and the disconnect?

There's nothing in 210.8(A) that would require GFCI protection for a hardwired A/C condensing unit.

One has already failed ballot and was not accepted. The one linked above, is the second attempt by a different submitter and with a different substantiation. Given that the first one did not pass ballot, I tend to doubt that this one will either.
