The receptacle appears more to serve the family room, but it is feasible that you could plug in an appliance and stand in the family room but use the counter space. I was told by an electrician that the NEC has added this to the list of locations required, but I couldn't find it.

The code says that in the kitchen, or at a wet bar sink, the receptacles intended to serve the countertop are required to have GFCI protection for personnel. The receptacle you are describing is not in the kitchen. Therefore, the requirement does not apply. You are welcome to add GFCI protection if you like, and are willing to pay for it, but the NEC does not require it.

Thanks. Needed to get that report out and would hate to have a builder angry with me.
