Grounded Conductor

Maybe someone can help me. Where in the N.E.C. does it mandate that a branch circuit supplied with type NM cable, the grounded conductor has to be insulated. A person ran a branch circuit an used the bare ground conductor as a grounded conductor. I know about 250. 140(3), but past that where does the N.E.C. mandate insulation on the grounded conductor for a branch circuit?

If they used the bare as a circuit conductor, what did they use for the EGC?

Please contrast these two definitions:

NEC 326.2 said:
Integrated Gas Spacer Cable, Type IGS. A factory assembly of one or more conductors, each individually insulated and enclosed in a loose fit, nonmetallic flexible conduit as an integrated gas spacer cable rated 0 through 600 volts.

NEC 334.2 said:
Nonmetallic-Sheathed Cable. A factory assembly of two or more insulated conductors enclosed within an overall nonmetallic jacket

The first definition specifies that each conductor in the cable is individually insulated. The second definition just specifies that there are at least two insulated conductors in the cable assembly; its silence on uninsulated conductors allows them to be present as well. If the NEC wishes to exclude uninsulated circuit/power conductors in the definition of NM cable, it needs to use specific language to that effect, like the first definition does.
