Top is feeding the range.

Bottom is feeding the 4500 watt HWH.

top one is OK

bottom one is a big problem

Someone just got mixed up when they were working in the panel.

Now a question:

When would it be ok inside a residential structure to use 10awg NM cable fed from a 50amp breaker?

For an AC condenser unit. In fact, #10 on a 50 amp breaker might be very common for that application.

Certain motor loads such as the air conditioning condensing unit or a large air compressor.

Not sure, but an air conditioning condensing unit would be one popular one.

I really didn't think that the black-red combination would be feeding the water heater. I'd have guessed a clothes dryer or a wall oven before I guessed a water heater.
 
I gotta ask about the lower termination on the top breaker. To my old eyes, it looks like the aluminum is completely severed from the terminal. It could be a shadow, or a small piece of black tape, but I doubt it.

My guess it's more like some strands were cut off.

I also see some NM entering the panel with no sheath showing.

Looks like shadow from the camera flash being higher than the lens.

I've seen some guys run 3 conductor to A/C units for some reason, more than likely because it's all they had on the truck.

That's not aluminum. Judging from the old insulation it's more likely tinned copper due to the rubber insulation.
