These are underground locations, how about above ground? Indoors?

Looking at ('05) 334.12(B)(4)...Where exposed or subject to excessive moisture or dampness

Then refreshing ourselves in Article 100:

Location, Damp.
Locations protected from weather and not subject to saturation with water or other liquids but subject to moderate degrees of moisture. Examples of such locations include partially protected locations under canopies, marquees, roofed open porches, and like locations, and interior locations subject to moderate degrees of moisture, such as some basements, some barns, and some coldstorage warehouses.

Location, Dry.
A location not normally subject to dampness or wetness. A location classified as dry may be temporarily subject to dampness or wetness, as in the case of a building under construction.

Which brings us back to 334.10(A)(1)
Type NM.
Type NM cable shall be permitted as follows:
For both exposed and concealed work in normally dry locations except as prohibited in 334.10(3)

Which brings us back to my question:
What type insulation is on the conductor.....is it listed in 310.13?
Does it have a "W" in it (ie, THWN)?

It will last fo 100 years in an outdoor enclosure or dry conduit.

Underground....not so much.

All of our NM is terminated outdoors in AZ. If it's good enough to sit in a metal box, it's good enough to sit in a metal tube.

....maybe you should write a proposal to get a passing vote from the CMP?

I?m not sure but I don?t think I?ll be installing NM above ground outside in a conduit just anywhere, unless it?s type NMC or UF. When I look this up I didn?t think to verify the definition of damp because I?m looking to qualify its use in conduit hence 334.15(B).

Even with these definitions it appears NM & NMS could be installed in conduit outside under an eve overhang.

I don?t know the cost or how readily available NMC is but this would be the cable to use in conduit outside and above ground, regardless if there?s an eve or no eve.

As stated earlier 300.9. Indoors you can install NM in conduit as long as you follow the fill as you suggested. Sleeves don't come under chapter 9 IMO. That is for raceways not sleeves.

I am not sure why indoors is being brought up I thought we were talking outdoors with romex inside conduit.

Your right outdoors, I only brought up indoors because there can be mindsets that think cable cannot be installed in conduit period.

Where are sleeves addressed in the NEC?
