How to bring floating fountain up to code?

I have a floating fountain that is fed from a pit. The pit is a permit required confined space, that has the pumps and electrical. The service is three phase 208V, the pump for the fountain is fed by three phase 208V no GFCI.
The service for the pit is not on a GFCI either. Probably installed about 20 yrs ago.
So right away does the service main need to be a GFIC or just the breaker feeding the fountain?
Does the electrical datum plane come into play?
This pit has a sump pump but i have seen it flooded to within a couple of feet of the aluminum door that is the entrance to the pit. By the way let me add that when it flooded last time the service was still hot, yes and it was completely under water.
 
Is the pump hardwired? I don't see any requirement for GFCI on hardwired fountain pumps, only for cord and plug connected.

Any lights in the fountain?

As far as the flooding goes, I would say the sump needs fixed so it doesn't flood.

The fountain is floating and hardwired, there are other hardwired pumps in the pit for other water features. The floating fountain has no lights. The sump works fine but when it flooded a pipe broke and it could not keep up. i'm working off a old code book 2014 look at 680.51 (A)
Anyone?
