Some 1 phase elevators use a 3 pole diconect the GC on one pole it has something to do with keepin emergencey power off with the disco off

Well first off, the EGC needs to be bonded to the enclosure. But, that's easy.

OK, here is a clue:

This is for a typical air conditioning condernser unit. This could be allowed for other types of equipment but usually not condensing units.

The installer forgot to connect the load and now the a/c doesn't come on. :roll:

Am lost 430.105 is as close as I can get but it about GC not EGC

Did you exspect to find fuses? Just guessing.

FWIW, I know you said that the Green is the EGC, but I have seen lots of old installations that used Green as an ungrounded conductor.

Clue #2:

Without giving you the code reference for EGC's and switches.....
The a/c units like this one have more than one source of energy.
