I brought 90.4 in after another poster said that there was no codes to allow for that inspector to reject, and clearly there is.

Fortunately that code won't work too well in CA.
AFCI receptacles are listed and accepted in the NEC.
Using listed equipment does not mean the AHJ has to approve it. See 110.2 and 110.3.

Though what OP intends to do was not permitted until 2011, 90.4 could be a way to allow it. 90.4 can be used to accept or reject though many just see it a a rejection method.

90.4 here is used to allow the use of arc fault protective receptacle outlets which are now locally available. We are on the 08.
