If the receptacle is installed more than 12" below the countertop then it can't be counted as the receptacle to serve the countertop, so therefore IMHO it need not be GFCI protected.

210.8(A)(6) requires that receptacles that are installed to serve the countertop in a dwelling unit kitchen must be GFCI protected.

Now 210.52(C)(5) states that receptacles installed to serve the countertop must be located above the countertop but not more than 20 inches above. The exception to 210.52(C)(5) permits (under specific conditions) the receptacle on an island or peninsular countertop to be located not mor than 12" below the countertop.

So receptacles that don't meet these requirements are not required to be GFCI protected.
