Pretty unequivocable.
250.52(A)(3) has an informational note at the end, like many other sections, I have seen may of these stated here as "not allowed", what would make one informational note OK to call out, but not another ? seems a bit subjective.

The code specifically says that informational notes are not enforceable. You can't get around that.

Unless it's a specific Code violation, and not a subjective one, if the man paying the bill is happy... "drive off" (around here referenced as FIDO)
