I did the bid on a major fire couple years ago.There was no question that the recess can (non ic) caused the fire.What was found is mr. homeowner had found just the guts of about 10 cans (no frame or junction box)he had open splices in ceiling and mounted them with 12 penny nails.On the demo almost at the end of the day we found the real answer,an insulation sticker dated about 6 months prior to fire.This kind of stupidity still gets paid for with insurance money ,this one to the toon of about $90,000 in damage.They needed to get sued and a claim like this would likely put them out of buisness.
On another major remodel i had noted that the cans were not thermal protected and thow insulation was pushed away from cans it was blown in and subject to moving.I pointed this out to the owners along with a price and recomendation to replace them.They did not like spending money but did agree it needed to happen.Insulators need to get educated.
