LDPE Corrugated conduit

I have a building we are re-designing after a partial roof collapse from snow load. in the building there is low density corrugated conduit otherwise known as 'smurf tube'. see link below for more information. i am trying to find out where this tube falls into the NEC. it has 120v cabling inside the tube now. if it isn't governed by the NEC, where would i find as to the approved applications of this tube?

Article 362, Electrical Nonmetallic Tubing (ENT).

First appeared in the 1984 NEC, but should have been in the 81.

The steel conduit manufacturers sent people to the NFPA annual meeting for the adoption of the 1981 code, and on a floor motion, prevented this product from getting into the 1981 code. That action ended up in the US Supreme Court in a case known as "Allied Tube & Conduit Corp. v. Indian Head, INC." I believe that Indian Head is the predecessor to Carlon, but am not 100% sure.
