"Approved" in OSHA rules is not the same as in NEC rules. In OSHA that word requires the use of a listed product. In the NEC it only requires it to be acceptable to the AHJ. In this case, I would not expect that the unlisted conduit would be acceptable to the AHJ because of the specific requirement in 350.6 that requires the conduit to be a listed product.

Thanks to all who posted in this thread. Just for a follow up in case any are interested in end result. Upon review of all parties involved. The faux LFMC was changed out, seal off's chiseled out with chico, listed LFMC was installed type UA and wiring was reran.
