Location of disconnect for a tenant in a mutiple occupan

I have a 3 story building where all the service disconnects, for the individually metered tenants, are located on the exterior wall of the rear of the ground floor (readily accessible).
I have then designed feeders from the service disconnects to the respective tenant's lighting and appliance panelboard that is located in the tenant suite. The tenant panelboard was designed as a MLO. The local AHJ has said that I need to provide a MCB panelboard per NEC.
Where in the NEC 2002 does it require the panelboards to have a MCB or even a local disconnect?

Nowhere. However, the NEC does require that all conductors be protected against overcurrent. Does the service disconnect (on the back wall) include overcurrent protection?

There is no local amendment to the NEC on this topic. The disconnect on the outside of the building does have overcurrent protection.

In my discussions with this inspector I have referenced Articles 230.72(C), 240.24 (A&B), and 408.16. Are there any other articles that I can reference to this issue?

After taking a look at this, I couldn't find more NEC references than those you've already included.

When the location of main breakers is explicitly required in panels, for special occupancies, the NEC language is clear.

1) Mobile Homes 550.11 (A)
2) Recreational vehicles 551.45 (C)
3) Park Trailers 552.45 (C)

It may strenghthen your argument to show some photo's of similarly arranged units & panels, in your area.
