Low Volt Landscape Lighting

I had a question from a landscape lighting contractor. He does not have to be licensed if he is working on the load side of a listed class 2 transformer and the wire is buried 6", per our state electrical inspectors.
1. Where does the 6" burial depth come from?
2. He wanted to know if he could install LV lighting on deck edge (where the wire is obviously not buried)
