Low-voltage luminaire in bathtub zone

Does the NEC permit installing a low-voltage (12V) luminaire above the tub (within the restricted zone)?

I know 410.4(D) prohibits pendant lights, track lighting, hanging and cord-connected fixtures in the bathtub zone, but I can't find anything in the 2002 NEC that addresses the low-voltage question.

Apparently surface-mounted or recessed luminaires are okay in the bathtub zone. Do you think that this "surface-mount" fixture (Model 809 3-light pan) can truly be considered surface-mounted, with respect to 410.4(D)??

Interesting ,not listed for a wet or damp location.Says nothing about GFCI Protection.It does protrude beyond the drywall.My guess INHO is not suitable.I searched their web site and under UL that one was not there.

I don't think that the 12 volts v. 120 volts is the issue. This fixture isn't a track light, a pendant light or a hanging and cord connected fixture so IMO the restrictions for within the tub zone wouldn't apply. The only question that remains is the location type. Is this a damp or wet location? The luminaire would need to be suitable for that specific environment.
