Luminaires required to be grounded?

I am hoping I can get some help. I have always understood 250.110(1) to apply to luminaires. That if the fixed equipment is higher than 8' from the ground, it doesn't need to be grounded. I am working on an OSHA citation which is taken from the 1981 code that is essentially the same as 2002 code.

It seems that 250.112(J) requires the luminaire to be grounded regardless of height.

What is your take?

My take is that 250.112 overrides 250.110, in that it talks about specific types of equipment. In its turn, 250.112(J) refers you to Pat V of 410. Within Part V, 410.20 says we must ground the luminaries, and does not talk about height. I think the issue raised by the OSHA citation is valid.

I agree.

Plus, one would have a hard time finding a install that didn't meet one of the eight conditions in "shall be grounded under any of the following conditions:" of 250.110 !
