Luminare T-code achieved with Zone protection installed in Division classified area

A fixture is listed for both Class I, Division II and Zone 2. It can achieve a T3 rating using a Zone defined protection method "restricted Breathing". If this protection method is removed by the installer from the fixture it's T rating approaches T1. Here is the rationale for installing this fixture in Class I Division II area and taking credit for the zone defined protection method.

NEC 500.8 (A) Suitability
 
Which of the Section 500.8(A) Subsections were you planning on using? Personally, I believe Section 501.5 would be a better application.
