Main breaker or main lug

A multi-family structure that is divide into 3 units by 2 hour fire seperations has main service disconnect load centers and main lug house panel board in each unit except one unit has both service disconnect for house load centers and main service disconnect load center. The service laterals and feeders are underground and come up in each unit. The question is the house main lug ok or should it be a main breaker so as to group the service disconnect with the house feeder disconnect for each unit that they supply.

Refer to NEC 225 II in particluar 225.30-225.34. Also refer to your building code. Here in NM, a two hour wall will create separate structures in a multifamily dwelling. If so, 225 will apply.
