In most cases in a motor circuit, the CB is there only for short circuit protection.

Which is why I asked if there is s motor starter involved. Without an answer, everything is speculations and what-ifs. If the answer is yes, it's pretty cut and dry, if the answer is no, it begs more questions.

Afraid it's cut and dry as is.

The motor of discussion is 10HP. As such, 430.32(A) More Than One Horsepower requires overload protection as a 1) Separate Overload Device, 2) Thermal Protector [neither of which will be part of a breaker], or 3) Integral with Motor.
