Yes, I have done a load calc for a few of the apartments and they need around 60A. But there isn't a code stating this is mandatory. Thanks for the quick reply and help.

Actually, yes there is. Your situation is different than that posed at the start of this thread. If you calculate the load at close to 60A, then you cannot use a 30A panel for the unit. Reference: NEC 408.30.

There may also be provisions in state or local housing code dealing with rental apartments that specifies minimum electrical supply to be considered habitable.
