Pix #2, hard to tell if it's not a Bellevue washer.
Pix #3, I'm going to say the bolts are not threaded all the way up, so they installed washers so they could tighten the nut down.

Great pictures Brian. Please tell me this was not in DC.
That is what it looks like. They could have installed the washers on the bolt head side between the head of the bolt and fitting and installed the the compression fitting tight to the surface or installed proper sized bolts.

Washer between the lug and bus, causing the lug to not make proper connection to the surface of the bus.
Picture #3
The lugs are not making proper surface connection to the bus, which can under load create excessive heat.
I have not seen an installation like this before.

2 is a listing issue bolt size and hole size, plus the washer.
3 is just commmon sense and may be a listing issue as well.

110.3(B) is the first section I would refer to. The manufacturer's product instructions would be next.
As I have been taught, the surface of the lug is to make contact with the bus, not a washer. The amount of surface area has been computed and designed by the manufacturer, UL and others. That info is found in the product standards and instructions.
