is there anything in the nec that says that if a stop button on a motor control is held in, the start button should not work?

this is not an E stop, just a regular start/stop station.

The code does not cover that issue, but in the standard 3 wire start/stop circuit, the start button will not function if the stop button is held in.

I'm not aware of a particular code section, however, most mfgs. show wiring diagrams with their controllers which call for the stop buttons to be in series. With that in mind, if push comes to shove, one could use 110.3(b)

ok.. if i bought a motor and associated equipment from a mfg. and used a three wire system instead of the four wire diagram. have i broken any rules?

A slightly separate issue is that many are PLC controlled, and neophyte engineers use NO pushbuttons for everything rather than the NC that should (my VERY STRONG OPINION) be used. A bad or missing input module allows starting, and indeed, prevents stopping the circuit.

IMHO, sound design practices would not allow energizing the starter with the stop button depressed. I am accustomed to separate control power for MCCs which will allow starter closure with the disconnect pulled. We used auxiliary switches so that logic opened the starter when the disconnect left either position on several jobs.

IMHO NFPA 79 covers this. 9.2.5.2.1 states "the start of an operation shall be possible only where all of the safeguards are in place and functional" with exception described in 9.2.4.
