Thanks for all the comments guys (even those that went off on a tangent). This particular inspector goes "head to head" with everyone he comes in contact with. Most electricians just go ahead and make the corrections he sites just to get the job over with and get paid. I don't let it end there though. If I believe I'm right I take it to a higher level. This guy has an axe to grind with the whole world. Many who knew him when he was a licensed electrician say that he was one of the worst violators of the code that they knew.
At the last new house I wired in his jurisdiction (6000 sq ft mansion) I got cited for 17 violations on the final. Some were legit but most were chicken scratch. Three in particular were outright incorrect on his part and I wrote to the code enforcement official at the Dept of Community Affairs in NJ and requested an interpretation. She ruled in my favor on all three accounts however, her last comment on each inquiry stated that her interpretation was "advisory in nature and not binding on any party." (I thought "What do we need her for?") However, she made an appeal to the inspector on my behalf but he refused to budge and I was forced by the builder to make the corrections (after the final I might add) so that we could all get paid.
The long and short of this is that if you believe you are correct and can provide documentation to support your case, don't stand down and take this abuse from overzealous inspectors. If we keep filing complaints with the State, sooner or later that inspector will get the message.
Most of the contractors in my Association refuse to do work in his jurisdiction. Fortunately, there is enough work around so we can make that decision. However, what it means for the homeowners in that municipality is that they will end up paying more for electrical work than any neighboring community because those who are willing to put up with his chicken scratch will charge a lot more. Wait until that hits the headlines !!!
