NEC-230.67D Surge protection

NEC 230-67.D " Where service equipment is replaced, all of the requirements of this section shall apply." Question, would a SPD be required when installing an automatic generator transfer switch for whole house on an existing system? The transfer switch would be installed between the existing meter and the existing panel. The service equipment was not replaced but the service was altered.
 
If the device that was the service disconnect before is still the service disconnect, I would say “no”.

To me that means that you replaced the service disconnect with new equipment.

The old one is still there, but it’s function has been replaced by the TS.

Probably an AHJ call.

I appreciate the feedback but I cant stand Starbucks. to me we didn't replace anything we altered the service and "added" something, a new disconnect. the Webster definition of replace " take the place of/provide a substitute for something that is broken, old or inoperative" "put something back in a previous place or position" I will probably loose this because of the authority having jurisdiction. I thought I had done my due diligence on code changes, didn't think of this situation though.
 
Some of the 2020 changes are issues that were not thought about, like you, I thought I understood them!
And I don't care for Starbucks either, they don't need my money.

The way I read the original question, he wants to know if he needs to install SPD at all. My original thought was “yes” but I’m beginning to doubt myself.

And for the record, I don’t like Starbucks coffee, either.
