I have floating fountain that is tethered to each bank of a pond and hooked up to a control panel that is supplied by the manufacturer. The control panel is supplied by building electrical supply. The question is would NEC 2014 682.14 exception apply or would have to provide disconnecting means? The exception says I dont have to have disconnect and the listed equipment can be fed direct wire if anchored in place and incapable of routine movement caused by water currents or wind. The confusing part is even if tethered the fountain may move little but not float away just like ship is anchored on sea it may move up or down maybe little left to right depending on currents or wind. So not exactly sure by incapable of routine movement.

My take is that Sealtite or flexible cord shall be used where flexibility is required. Your tethered anchoring would seem to meet that, as the fountain won't be floating around but will rock with water movement. In other words, rigid conduit wouldn't be suitable.
