NEC 700.12 (D) Separate Service Drop Other loads

We have a few (a lot) buildings that were built in the 1960's. Commonly at each building we have a 3 phase service disconnect and a single phase service disconnect located next to each other, both providing power to the building. Both service disconnects are supplied from the same utilty transformer but (may) have their own service drops. The normal lighting is supplied from the single phase service disconnect. The emergency lighting is supplied from a tap on the line side lugs of the 3 phase service disconnect.

1. Is the seperate service drop allowed in NEC 700.12 (D) (1) Separate Service, only allowed to serve emergency loads? Can it also supply the 3 phase equipment in the building also supplied by the 3 phase service disconnect?
2. Even if 1 is allowed, the service drops are within inches from each other and don't meet 700.12 (D) (2)

Only the AHJ can answer these questions as 700.12(D) specifically mentions the AHJ.

Here in my area what you describe would not be acceptable as the only means of supplying egress lighting.
