Nec 700.9 (b)?

Can you run two MC cables (one emergency and one normal) inside a steel canopy to feed a single sign/lighting load? Or would that be a violation of NEC 700.9 (B)? Would the canopy be considered as a conduit and therefore an argument can be made that you are running an emergency circuit and a normal circuit within a single conduit?

The only path for me to feed a certain load is to go through a steel canopy which looks like a large conduit. Would code consider this canopy as a conduit? If so, would it be problematic if it contained two separate MC cables where one MC cable was feeding a normal load and the other MC cable was feeding an emergency load?

Sorry, I used "canopy" instead of "pole" above. The only path for me to feed a certain load is to go through a steel pole whith a hallow core which looks like a large conduit. Would code consider this pole as a conduit? If so, would it be problematic if it contained two separate MC cables where one MC cable was feeding a normal load and the other MC cable was feeding an emergency load?

The AHJ could use 700.1 FPN. #3 " public safety communication systems" as a reason to deem the system as a emergency system. This could be the signs over interstates that warn motorist about wrecks ahead, road construction and Amber alerts.

I did not say could not, I said that I doubted it.

The difference could be quite a bit of money so I would want to find out for sure.
