There is no question that the busway is equipment, but the rule applies to equipment that contains "overcurrent devices, switching devices, or control devices". The busway, in my opinion, does not contain any of those things.

Seriously, there is enough room for argument on all three sides that I expect it will come down to the individual AHJ.

The rule does not apply to equipment in general...it only applies to equipment that contains one of three things, has a rating of 1200 amps or more and not less than 6' wide.
