New company that wants to use my license.

Good day I am a master electrician and have recently started a new job. I was approached by them to become the master for the company. I have no idea what the laws are for me to make sure I am doing the right thing. Also I feel like I should get incorporated or something like that. Also should I receive special perks. I was always just a electrician working for a company never this important. Just want to know how important I am to this new company and make sure I'm compensated to the fullest. Thanks

Not only is proper compensation a concern, but potential liability should be a concern.

You may even want to consult with an attorney before making any decision on this matter.

I would suggest you have more then just a W-4 and a wage/salary with this company. You should probably have some kind of contract with them that spells out who is responsible for what in your relationship to the company.

If they can't understand that, you probably do not want to work for them under the conditions they are asking for, it may bite you someday.

Some places what you suggest may not even be legal, others maybe can be made legal under certain conditions.
 
In Massachusetts if they are incorporated you must be one of the corporate officers. It might work out for you if you actually supervise the work like you have liability if something goes wrong. Taking on that responsibility is worth compensation that only you can determine if it is worth it. If they just want to rent your license and keep you uninvolved with the supervising then even with compensation it is a risk you may want to decline.

it sounds like your Company wants to bring you closer to the business end of things..

Have an open conversation with them and voice your concerns, Generally people get ahead in life by saying Yes, go with your positive feelings and good luck !

The company has multiple offices mass,ct,nh so I want to make sure that they have me on there insurance? Should I be asking for more? I started job already but haven't done any paperwork for them using license yet. I don't want to ask for the world and have them reconsider their relationship with me.

it's different from state to state, that much i know.

my first thought is why a company with multiple offices is looking to run under your license.....
if you were running work in three states, wouldn't YOU have a license nailed down for your use by that point?
it's one thing if someone is just starting out, but by the third state.....

pretty much anywhere, however, is that work done under your license, you have some legal liability and responsibility to the job.
if all goes well, then it doesn't matter. but if it doesn't go well, could you be held liable to complete a job that you had no hand
in the money on?

CA prohibits contracting under another persons license.
they also prohibit most everything else, but that is another story.

my not so humble opinion is you need professional legal advice. listening to someone like me, someplace like this, is not in your best interest.

The current licensee will be let go because of using someone else's license to pull permit.
This is the reason for needing a new master license.

Employees don't get licensed, the get certified. They cannot contract nor pull permits accept as a authorized agent of the company.
A person who is licensed and the qualifier of another company is legally responsible for the actions of the entity.

What Fulthrotl was speaking of is one person or entity using another contractors license to pull a permit. The license would have to be legally the other person or entity.

For California that is.

In MA you need to be an officer in the company. Only 1 master license is issued under your name. You cannot have your own business with your licence and then use it with another company. you would need to withdraw the licence from your name and apply to the board with the name change. They will than approve of the license or deny.

Depending on how big the company is would determine how much compensation you should get.

From the company having multiple licences in different states just wondering if this is for a solar company.

You mention Mass, CT, NH...With the possibility of work going on in three states it must be a sizeable firm. I would question why the top officers are not already licensed Master Electricians ? Or are the top dogs just the business end of things ? There is too much at stake here, as has been said consult a Lawyer.

Not a true electrical contractor..they are sick of subbing electrical work out and have recently started electrical division.

So you have some investors that are not qualified to do electrical contracting that are operating a contracting business.

They need to realize if they want someone that is qualified to stay for a long time they need to compensate them correctly, as well as let that person join the management team. Understandable that if you have little equity into the company you have little business decision power, yet the license holder is an important position to the company's existence.

I'd be a little leery if you are a fairly new employee and they make such request. This is the kind of thing they should be looking for from someone they have a longer relationship with and already have some trust with that individual. Don't let them take advantage of you.

my inner cynic wonders at something like this. most of us want to be an integral part of
something, and diving into it and then finding out that your part was to fall on the grenade
doesn't feel good.

many of us are better sparkies than we are businessmen. i'd say that applies to me, anyway.

I feel I am a better sparky then businessman myself. I probably cheat myself of some money I maybe should earn because I feel I am taking advantage of others in some aspects. But learning the hard way at times and do charge people for some things or more for some things then I once used to - business is business and you have to do what you have to do sometimes or you will go under.

He did say they just started the electrical division. As a lot of contractors they probably had limited loyalty with their subs. They had a guy that pulled permits for them, but he was working other sides of the street too, so they are looking for someone else to work with them on the permits. He is already employed, so why not at least talk to him.

Talk to them. See what they are offering and tell them what your concerns are. If it interestes you tell them you will let them know.
 
My question is you have a Mass license? My Ct license is only good in Ct as far as I know. So do they have a guy with Ct and NH license? If so maybe you could find out their deal. (If not give me a call $500 a pop.:D)
