Minimum grounding electrode conductor is 4Awg.
NM, NMC or NMS can only be used in residential r2 and r1 House and single story apartments.
This goes on and on with complete changes from the NEC.

Because they can I suspect. The Changes aren't enforceable until July 1 and I failed a pre-final because the inspector had the changes before we could get them.

I did read that section from the link he provided and it refers to concrete encased electrodes. #4 no mater what.
