New Service RI 2020 NEC Grounding

Underground service in 2 inch PVC Schedule 40
Conductors 4/0-4/0-2/0
Main breaker (Emergency / Service Disco) ATS Located at Pedestal Meter socket remote from house
MLO Panel located in homes basement
Ground rods located in Basement
Bonding jumper located in ATS and at Panel in basement


Argument: Since the ATS has the overcurrent protection.
-would the panel be considered a sub panel and a #6 ground be required to be pulled to provide a separate path for ground faults?
-would ground rods need to be relocated to the ATS
Remember RI is on the 2020NEC
 
The ATS is the service disconnect so the panel is a sub-panel and would require an EGC to be pulled with the feeder.

The service disconnect requires a connection to a GES.

If the panel is in a separate structure that would require a connection to a GES for that structure. The panel also requires a disconnecting means which can be a main CB. A MLO would require a separate disconnect if used without a main.

What NEC would require the MCB in the basement/ separate structure?
 
The 2026 will clear up the issue as to how far away from a one- or two-family dwelling the service disconnect can be. If the disconnect is located in accordance with 110.29, no main will be required at the dwelling itself.
