I can find double pole, double throw non-fused switches from Siemens that are listed as suitable for use as service equipment. I didn't find an actual transfer switch.

Please note that the OP did NOT use the term "transfer switch" and he did not indicate there was a generator in this mix.

The designer is saying his design follows 230.82(5) "Taps used only to supply load management devices, circuits for standby power systems, fire pump equipment, and fire and sprinkler alarms, if provided with service equipment and installed in accordance with requirements for service-entrance conductors."
I think the designer is wrong, Tap means you are tapping the conductors ahead of the service and installing a separate fused disconnect to feed one of the items above. not putting a double throw switch between the CT cabinet and the Service Entrance Disconnect.
Any more thoughts?

The designer has a 4 pole double throw switch between the CT cabinet and the Service Entrance Switch to be used as stand-by power froma portable generator.
hope the adds some more details.

Will the proposed switch feed 100% of the service load? If not where are the service OCPDs, located in relation to the double pole switch?

I don't see it as any type of tap...I see the double pole switch as the service disconnect. It appears that this would be an Article 702 system, and it appears that a double throw switch would meet the requirements of 702.5. Note that it is my opinion that the double throw switch would have to have an "off" position.
