sq d has a new ul listed brk. # 2200 .it takes up 4 spaces.ques ? can you use this type of brk to feed a 200 amp 30 cir mlo panel off a 200 amp 40 cir panel with a 200 amp main? the 2008 code now adress es these larger panels with up to 60 spaces.what if your state has yet to adopt the 08 code such as pa . does this prevent you from using this brk? even though it is ul approved.

Yes, as long as its an approved-for-the-panel breaker type.

No, because a sub-fed panel's breakers do not count as using the main panel's spaces.
 
Are you saying that a circuit breaker supplying a subpanel is not counted as one of the circuit breakers in a panel when counting how many circuit breakers there are in total?
Of course not. I'm saying that the sub-panel's circuits do not count. Naturally, the sub-panel's feeder breaker counts in the main panel.

I took the OP's question to be concern that the sub-panel's circuits would take the main panel's count over the pre-'08 limit of 40 circuits.
