It isn't as simple as just rounding up a posse and bringin' 'em in.kmc said:...and they have done nothing!
January 3, 2007 MinutesMr. Aicher stated that it is not fair to the licensed electrical contractors who may have to pay higher licensing fees because the Board is spending money trying to locate unlicensed individuals.
Ms. Kane stated that the Board should be consistent in the amount of civil penalties assessed. The Board must separate the penalties assessed from its costs as the Board can collect monies expended for Enforcement Bureau activity. If the Board is charged $1,000.00 by the Enforcement Bureau to locate an individual, or is charged for the appearance of the court reporter and for the transcript that has been ordered, the Board can then incorporate those costs onto the unlicensed individual when preparing a settlement offer
That posse needs to get paid.
And they should be.
These individuals operating outside the law are criminals and should be treated as such right from the first encounter...similar to how the authorities deal with a robbery in progress ~ it can be dangerous work to tell someone that they "out of business". The agents need to be prepared to for all sorts of responses from these folks....from the simple "Oh, gee..I didn't know" ...to the the "Who the FAQ are you and what army is gonna stop me!" mentalities.
After one of these individuals is "brought to justice"...they get to pay, and pay they do:

You can see the real names at the site linked below.
These are just a few....there is also plenty of LICENSED guys caught doing what they shouldn't.
All this costs money to enforce:
That's about $90k annually. The Board reviewed a memorandum dated July 17, 2006, received from Darlene Kane, Budget Officer, Division of Consumer Affairs, stating that for the fourth quarter of Fiscal Year 2006, the Board/Committee was directly billed for 187.3 hours of Deputy Attorney General/Paralegal services totaling $22,265.33.
Hopefully (that means legally), the Board will be able to pass this tab onto the lawbreakers and let 'em pay THEIR own dam bill.
