nm in wet location?

I do mostly commercial work , but am now taking on some residential . Called for a final on a house and it failed. Inspector said I ran romex from disconnect to condenser and this is not allowed for it is a wet location. The romex is installed in sealtight though. Is romex not allowed outside at all? Even though it may be protected from the weather by pvc, sealtight, rigid, etc.?
 
225.22 Raceways on Exterior Surfaces of Buildings or Other Structures
Raceways on exteriors of buildings or other structures shall be arranged to drain and shall be raintight in wet locations.
Exception: Flexible metal conduit, where permitted in 348.12(1), shall not be required to be raintight.



This basically says conduits located outside are wet locations.

Types NM and NMS. Types NM and NMS cable shall not be used as follows:

d. Where exposed or subject to excessive moisture or dampness

Which goes hand-in-hand with 225.22

so if you had a situation where you had to add a circuit to an outside panel , you could not run romex through the attic and install it in conduit right after it exits the building? Im guessing the AHJ would determine excessive.
 
If I recall, a friend of mine made a proposal to the 2008 to change this section from "excessive moisture or dampness" to "wet locations". I beleive at this stage of the game it is passing.

The inspector may and could do just that. :cry:

Inside a conduit is not a location; where the conduit is located is. If there is wire in the conduit, and the conduit is in a wet location, the wire is in a wet location.
