Met with the GC yesterday and I informed him I wouldn't pull a permit, oder material or start the project without a contract. He said I would have it Monday. This is a public works job and a I feel a contract is always needed unless in very specific cases where you have a long working relationship with someone. If someone balks at a contract there is usually a good reason, i.e. they plan on $%#^(&^%% you over.

Anything to do with public works.. AKA "other peoples money".. you need the job spelled out so you can bang them for extras.. :D

Supposed to start a new project on Monday and the GC still hasn't given me a contract because they are waiting for the owner to sign it. Makes me wonder how long it will take the owner to sign the checks :-? I have a "no contract no starting work" policy for my business. Any comments about starting without a contract?

I'd advise against it but your lawyer is the one to call if you need an education in the legal issues involved.

A letter of intent or emailed notice to proceed is all I need to start a job with contractors I've worked successfully with in the past. I wouldn't release gear, fixture or wire orders without a contract, but if a guy says he's going to get me a contract next week, and throwing some conduit up in the air or in a slab is going to get me a little bit ahead on a job, I have no problem doing so.

If 1 in 20 jobs like this bite me in the azz, I'm pretty sure I'm making up for it by getting ahead of the game and not having to pay overtime at the end of the job for the other 19.
