non-grounding receptacles

I do not see anything in the NEC that prohibits me from installing a new NEMA 10-50 receptacle in a commercial building on a 208/120v Y grounded system. The outlet branch circuit will have 2 phase conductors and a neutral (no ground). The outlet will serve an existing portable welder with a NEMA 10-50 plug. Is there a reason to be concerned about this installation?
 
I started at 406.3(A) and (B). Since (A) does not apply, and a 10-50 does not have grounding contacts, I concluded compliance. Are you aware of any other relavent Articles?
 
No, I don't

The L10-50 is designed to be connected to the System Ground, not the EGC.

It seems to me that the welder really requires a grounding conductor, not a grounded conductor.
 
Is this a factory installed cord cap on the welder or has it been changed?

I know we like to say that the NEC stops at the receptacle however 250.114 seems to jump past the receptacle. A welder and it's grounding may be covered by some part of 250.114.(4)

Not really sure about it.
 
Closest thing I see is 250.114(4)(f) and that covers appliances. Don't believe a welder is an appliance. Looks like the 10-50 is OK IMO. I usually see a 6-50 plug on welders.
